CJI Permits CBI To Investigate Against Sitting HC Judge

CJI Permits CBI To Investigate Against Sitting HC Judge

The Chief Justice of India Ranjan Gogoi has given green signal to the Central Bureau of Investigation (CBI) to file an FIR against sitting Justice of Allahabad High Court S N Shukla.

Gogoi has permitted the investigation agency to book the sittingjudge under the Prevention of Corruption Act for allegedly favouring a privatemedical college in its MBBS admissions.

It may be mentioned that the Supreme Court of India had prevented any investigating agency from lodging an FIR against a sitting judge on the K Veeraswamy case way back in 1991 without first presenting evidence to the CJI.

Notably, no investigation took place against any sitting judgebefore 1991.

The CJI's call for an investigation by the CBI is the first of its kind to register a case against a sitting judge.

The CBI, is however, all set to file the case against JusticeShukla that might also lead to his arrest under the PC Act.
