New road block for NRC at SC, new bench created, hearing on Monday

A new road block has been created in the supreme Court as the Chief Justice of India Deepak Mishra created a new bench consisting of Mr. Justice Arun Mishra and Mr S Abdul Nazeer to look into the petition in regard of status of the siblings of D voters and those declared foreigners in the upcoming NRC. This new move may complicate the release of NRC on July 30 now.

The new bench will now separately heard the NRC matter despite the presence of an existing bench comprising of Mr Justice Ranjan Gogoi and Mr Justice Rohington Nariman.

This is noteworthy that the Gauhati High Court Had rejected an earlier petition seeking inclusion of the names of the siblings of D Voters and Declared Foreigner in the upcoming final draft of the NRC. This was challenged by Congress MLA Kamlakhsa Dey Purkaystha and Nurul Huda in the Supreme Court.

In this regard the Chief Justice Deepak Mishra constituted a separate bench to urgently look into the matter and it will come up for hearing on Monday next. This means there are now two separate benches hearing the same issue in the Supreme Court.

This is an interesting development, which has once again brought out the internal clash between Chief Justice of the Supreme Court Deepak Mishra and next in line Mr Ranjan Gogoi into the fore on the matter of allocation of cases. The constitution of the new bench may hurt Mr Justice Gogoi , who had been passionately spearheading the NRC process into Assam.

If the new bench has to give a verdict in favour of petitioner, there will be once again jeopardy in releasing the list on July 30.
