Kumar Sanjay Krishna, Addl. Chief Secretary to the Govt. ofAssam (Home & Political Department) has issued a public notice ahead of NRCfinal draft publication. As the NRC will be finalised on August 31 and in thisregard, the following important aspects are brought to the notice of the public:
1. The process of updation of NRC in the state of Assam isbeing carried out by the Registrar General of India and the entire process isunder the direct monitoring of the Hon'ble Supreme Court.
2. Under the provisions of Foreigners Act, 1946 and ForeignersTribunal Order, 1964, only Foreigner Tribunals are empowered to declare aperson as a foreigner. Thus, non-inclusion of a person's name in NRC does notby itself amount to him/her being declared as a foreigner.
3. For the benefit of those whose names do not appear in theFinal NRC, appeals can be preferred as per Section 8 of Schedule to theCitizenship (Registration of Citizens and Issue of National Identity Cards)Rules, 2003. The Government of India has extended the time-limit for filing ofappeals from 60 (sixty) days to 120 (One hundred twenty) days, and necessaryamendment in this regard has been made in the Foreigners (Tribunals) AmendmentOrder, 2019.
4. 200 new Foreigner Tribunals are being set up shortly forhearing the appeals filed in the designated Foreigners Tribunals which will benotified by the State Government very soon.
5. Another 200 Foreigners Tribunals will be set up soon andendeavour is being made to set them up at convenient places so that filing andhearing of appeals is done smoothly and efficiently.
6. State Government will also make necessary arrangements toprovide legal aid to the needy people amongst those excluded from NRC byproviding all assistance through the District Legal Services Authorities(DLSA).
7. Persons left out of the final NRC will not be detainedunder any circumstances till Foreigners Tribunals declare their decisions.
