Decision of Foreigners Tribunal will succeed over NRC

The top court on Friday ordered that an Assam Foreigners Tribunal's decision on illegal foreigners will be compulsory and that it will succeed the state government decision on the inclusion or exclusion of a person in the Assam NRC.

A bench of Chief Justice Ranjan Gogoi and Justices DeepakGupta and Sanjiv Khanna was dealing with the question that if the name of aperson, included in the NRC in Assam is deleted on the ground that he was aforeigner, then he should have a right of appeal before an appropriate forumagainst exclusion or dropping of his name.

Justice Sanjiv Khanna said that the principle of 'res-judicata' (a judicially decided issue cannot be re-agitated) would apply on the decision of foreigners tribunal and a person who has been declared an illegal immigrant cannot seek re-decision in normal circumstances.
