The Gauhati High Court has issued a fresh directive for the reinstatement of dismissed gazetted officers in the Assam Public Service Commission (APSC) recruitment scam.
Those officers who were removed on charges of securing jobs through forged answer scripts have been directed for reinstatement by the court.
The order, passed by the bench of Justice Kalyan Rai Surana and Justice Malasri Nandi, directs that the dismissed officers be reinstated in service within 50 days. However, the court has made a key distinction between officers who completed their probation and those who did not.
According to the order, officers who have not completed their probation period will not be entitled to the benefit of reinstatement under this directive. Those who have completed their probation may be subject to departmental inquiry if deemed necessary.
The court also clarified that the order will remain inoperative for 30 days, giving the government time to appeal or respond accordingly.
The officers in question were dismissed after being found to have obtained government jobs using forged and tampered answer scripts during APSC’s controversial recruitment process.
