A petition has been filed in Supreme Court challenging the vires of Section 62(5) of the Representation of People Act, 1951 (RP Act). The said provision prohibits a person confined in a prison from casting vote.

The Supreme Court has finally agreed to hear the public interest litigation (PIL), a bench headed by CJI Ranjan Gogoi posted the hearing in the matter after two weeks.

The Public Interest Litigation (PIL) petition has been filed by Aditya Prasanna Bhattacharya, a third-year law student from the National Law School of India University, Bangalore.

The SC also asked the petitioner to appraise why he picked up the particular cause that too under Article 32 of the Constitution of India.

Article 32 of the Indian Constitution gives the right to an individual to move to the SC to seek justice when they feel their right has been 'unduly deprived'.
